Further, the Customer shall not resell, redistribute, transfer, assign, donate, repackage, relabel, or otherwise provide any product to any third party without our prior written consent. The Customer is solely responsible for ensuring that any possession, storage, handling, transfer, disposal, or research use of any product complies with all applicable laws, regulations, institutional rules, and safety requirements.

By purchasing from FirstForm Peptides, you represent and warrant that:

• You understand that certain compounds may not be listed on the Toxic Substances Control Act (TSCA) inventory, and you accept full responsibility for verifying compliance for your intended use.
• You are not located in, organized under the laws of, or ordinarily a resident in any jurisdiction subject to comprehensive U.S. sanctions, and are not identified on any U.S. government restricted-party list. You shall not export, transfer, divert, or otherwise provide any product to any person, entity, or jurisdiction in violation of applicable export control, sanctions, customs, or trade laws.

The statements and information provided on the Website have not been evaluated by the U.S. Food and Drug Administration (FDA). Products sold by FirstForm Peptides or on the Website are not intended to diagnose, treat, cure, or prevent any disease; and no information on the Website should be construed as medical advice. FirstForm Peptides is a research-use-only (RUO) chemical supplier and not a compounding pharmacy, medical provider, or outsourcing facility under Sections 503A or 503B of the Federal Food, Drug, and Cosmetic Act. Products shall not be used, marketed, purchased, discussed, or requested for any human or animal use, including but not limited to therapeutic, diagnostic, clinical, nutritional, supplement, cosmetic, wellness, bodybuilding, weight-loss, anti-aging, fertility, sexual health, aesthetic, or performance-enhancement purposes. Any customer communication suggesting such use may result in refusal of sale, cancellation of orders, account termination, and inclusion on our restricted customer list.

Any communication by the Customer which leads us to believe that the Customer will use or intends to use our products in a manner other than that for which they are intended will result in a "Refusal to Sell" alert or a "Blacklist" email being sent to the Customer. This means the Customer will no longer be able to make purchases on the Website. All collected information will be added to our internal "Banned" database, which every order is checked against. If the Customer receives a ban, it is permanent. FirstForm Peptides will not, under any circumstances, tolerate the misuse of the Website or the products sold on the Website.

The following Prohibited Uses will not be tolerated and will land you on our Blacklist, which, as mentioned, is a lifetime ban. The products shall NOT be used for:

• Human or animal consumption;
• Diagnostic, therapeutic, or clinical applications;
• Compounding under Sections 503A or 503B of the Federal Food, Drug, and Cosmetic Act;
• Performance enhancement or aesthetic purposes;
• Any consumer, agricultural, or commercial applications; or
• Educational demonstrations involving human or animal subjects.
• Please note that the foregoing list is not exhaustive, and FirstForm Peptides reserves the right to suspend or terminate the Customer’s account at any time, with or without notice, if the Customer violates these Terms or if we believe the Customer has violated or intends to violate these Terms.

FirstForm Peptides assumes that the Customer is familiar with the products being purchased, and does not provide any type of guidelines or suggestions regarding use of the products. If a Customer asks us for such information, then the Customer will be answered with a "Refusal to Provide Guidelines" email. The Customer acknowledges that any request for usage guidelines may be considered evidence of lack of qualification and may result in order cancellation and/or account termination.

The Customer represents and warrants that the Customer is affiliated with a laboratory, institution, university, or other research-based facility which is purchasing and using the products sold by FirstForm Peptides for research purposes only. FirstForm Peptides reserves the right to perform due diligence screening upon receiving an order, and FirstForm Peptides, in its sole and absolute discretion, may require verification of affiliation prior to order fulfillment. The Customer agrees to provide such verification within five (5) business days of request. Failure to provide verification within this timeframe shall result in automatic order cancellation without refund of any deposits or fees paid.

Unless otherwise specified, the Customer’s use of the Website is governed by these Terms. In using the Website, the Customer is prohibited from modifying, distributing, transmitting, reproducing, publishing, licensing, transferring, or selling any information, products, or services obtained or viewed on the Website. The Customer may, however, display, download, or print hard copies of any material contained on the Website for the Customer’s own internal, non-commercial research use, as long as the Customer does not modify the content or delete any copyright, trademark, or other proprietary notice. Any other use of the information contained on the Website is prohibited without our express prior written consent. Unauthorized use may result in immediate account termination and legal action.

We reserve the right to correct any inaccuracies or typographical errors in the information posted on the Website and shall have no liability for such inaccuracies or errors. Information may be changed or updated without notice, and prices and availability of products are also subject to change without notice. We shall not be liable to the Customer or to any third-party for any modification, price change, suspension, or discontinuance of the sale of any product.

We do not guarantee, represent, or warrant that the Customer’s use of the Website will be uninterrupted, timely, secure, or error-free. From time to time, we may remove the Website for indefinite periods of time without notice to the Customer. The Customer’s use of, or inability to use, the Website is at the Customer’s sole risk. The Website and all products offered for sale through the Website are (except as expressly stated by us) provided "AS IS" and "AS AVAILABLE" for the Customer’s use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

By providing your mobile telephone number and opting in — including by checking the SMS consent box at checkout, in our welcome offer, or on our partner program application — you expressly consent to receive recurring automated marketing and informational text messages (such as new-product drops, restock alerts, promotions, and partner program updates) from FirstForm Peptides at the number provided, sent using an automatic telephone dialing system or other technology. Consent is not a condition of purchasing any goods or services.

Message frequency varies. Message and data rates may apply according to your mobile carrier and plan. The Customer agrees to provide current, complete, and accurate purchase information, including payment and contact information, for all purchases made on the Website. We reserve the right to refuse or cancel any order at our sole discretion, including after payment has been received. In the event of order cancellation, our sole obligation shall be to refund the purchase price paid, and we shall have no liability for any consequential, incidental, or indirect damages.

Prices on the Website are invitations to conduct business, not binding offers.

All customers must be 21 years of age to place an order or make a purchase.

The Customer’s purchase order constitutes an offer

A contract is formed only upon our written confirmation of acceptance of the Customer’s order, which may be provided via email or through the Website.

We expressly reject any conflicting or additional terms in the Customer’s purchase orders, invoices, or other documents, and any such terms shall be void and of no effect. These Terms constitute the entire agreement between the parties and may only be modified by a written amendment signed by an authorized representative of FirstForm Peptides.

All prices are in USD, unless otherwise specified.

Prices exclude taxes, duties, and shipping charges.

Prices are subject to change without notice.

The Customer is responsible for all applicable taxes.

We accept:

• Major credit cards (Visa, Mastercard, American Express, Discover)
• ACH/wire transfers

ALL SALES ARE FINAL.

Orders are non-cancellable once payment is processed.

We do not accept refunds, except on products with verified manufacturing defects.

Late payments accrue interest at the rate of 1.5% per month (18% per annum) or the maximum rate permitted by applicable law, whichever is lower.

If the Customer initiates a chargeback without first contacting support@firstformpetptides.com in writing and allowing FirstForm Peptides thirty (30) business days to investigate and attempt to resolve the dispute in good faith, the Customer agrees that such action may be considered a material breach of these Terms, and FirstForm Peptides reserves the right to pursue the following remedies:

• Immediate account termination;
• Collections proceedings, including attorneys’ fees;
• A $2,500 liquidated damages fee; and
• Reporting to regulatory authorities.

Shipping and delivery dates are estimates only. Title and risk of loss pass to the Customer upon delivery of the product to the carrier, except where prohibited by applicable law.

Delivery Restrictions; Force Majeure

FirstForm Peptides shall not be liable for delays, losses, or costs associated with acts of God, war, terrorism, civil unrest, government actions, labor disputes, supplier failures, failed delivery attempts, carrier errors, weather events, reshipments that result directly from incorrect or incomplete addresses provided by the Customer at checkout, or other events outside our reasonable control. FirstForm Peptides shall not be responsible to notify the Customer in the event of such delays or of any apparent address issues prior to shipment, though it may do so as a courtesy. The Customer shall be solely responsible to make other arrangements to purchase alternative products and cover any costs incurred in connection with such purchases. In the event of a force majeure lasting more than ninety (90) days, either party may terminate the affected order without liability.

Shipping is limited to the continental United States only.

Shipping methods, carriers, availability, and any regional restrictions are as shown at checkout.

We use UPS and FedEx exclusively.

We reserve the right to refuse high-risk addresses.

Returns and Refunds Policy

Due to the nature of research chemicals, and safety and contamination risks:

• NO RETURNS OR REFUNDS (with the exception of verified manufacturing defects).
• No cancellations after payment.
• No exchanges.
• Returns, refunds, or exchanges are not accepted once an order is placed.

The Customer must:

• Inspect shipments immediately upon receipt;
• Report any issues in writing to support@firstformpeptides within seven (7) calendar days of delivery, with such notice deemed given upon sending; and
• Provide photographic evidence and, where applicable and reasonably available, analytical data supporting the claim.

For verified manufacturing defects only, at our discretion we may issue:

• A replacement with conforming product, OR
• Credit toward future purchase, BUT
• Cash refunds are not available except as may be required by applicable law.

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS OR AS REQUIRED BY APPLICABLE LAW, PRODUCTS ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

The Customer is solely responsible for reviewing all available product specifications, labels, warnings, certificates of analysis, safety data sheets, and other product documentation before opening, handling, storing, transferring, using, or disposing of any product. The Customer is solely responsible for maintaining appropriate facilities, equipment, personal protective equipment, storage conditions, disposal procedures, and safety protocols for laboratory chemicals. We do not provide safety training, dosing information, administration instructions, medical guidance, veterinary guidance, or experimental protocols.

FirstForm Peptides makes no representation regarding:

• Experimental outcomes;
• Product performance in specific applications; and
• Batch-to-batch consistency beyond specifications.

FirstForm Peptides’ total liability shall not exceed the purchase price of the specific product giving rise to the claim. We are not liable for:

• Indirect, consequential, or incidental damages;
• Lost profits or business interruption;
• Personal injury after title transfer; and
• To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to any product, order, Website use, or these Terms shall not exceed the amount actually paid by the Customer for the specific product giving rise to the claim.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FIRSTFORM PEPTIDES OR ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE WEBSITE, RELIANCE ON INFORMATION PROVIDED ON THE WEBSITE, OR THE USE, MISUSE, HANDLING, OR STORAGE OF OUR PRODUCTS, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

In direct consideration of the sale, the Customer agrees to indemnify, defend, and hold harmless, FirstForm Peptides, its owners, members, managers, employees, affiliates, and agents from any claims, losses, liabilities, or expenses (including attorneys’ fees) arising from the Customer’s use of the Website; the Customer’s handling, misuse, or transfer of any product; or from any violation of these Terms. This indemnification includes any action taken by a third party resulting from the Customer’s actions or omissions.

The listing of a product on the Website does not grant or imply any license to use it in violation of any existing patents. All trademarks, logos, and brand names displayed on the Website remain the property of their respective owners.

FirstForm Peptides owns all intellectual property rights in:

• Website content and design;
• Product formulations and synthesis methods;
• Trademarks and trade names; and
• Technical documentation.

The Customer shall not:

• Reverse engineer products;
• Use FirstForm Peptides’ intellectual property to develop, manufacture, or market products that compete with FirstForm Peptides’ products or services;

• Use automated means (including bots, scrapers, or similar data mining tools) to access, scrape, or harvest data from the Website.

The Customer receives a non-exclusive, non-transferable, revocable license to use the products solely for internal research purposes in accordance with these Terms. All intellectual property rights in the products remain with FirstForm Peptides. The Customer may access and use the Website solely for the purpose of ordering products and receiving related services. The Customer shall not copy, reproduce, republish, upload, post, publicly display, encode, translate, transmit, or distribute any part of the Website or products without FirstForm Peptides’ express prior written consent.

These Terms, and any dispute, claim, or controversy arising out of or relating to the Website, any order, any product, any communication with us, or the interpretation, enforcement, breach, termination, validity, or performance of these Terms, shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict-of-law rules or principles.

To the fullest extent permitted by applicable law, the Customer agrees that any action, suit, or proceeding arising out of or relating to these Terms, the Website, any order, or any product shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and the Customer irrevocably submits to the personal jurisdiction of such courts. The Customer waives any objection to such courts based on lack of personal jurisdiction, improper venue, forum non conveniens, or any similar doctrine.

Nothing in this section shall limit our right to seek injunctive, equitable, or other emergency relief in any court of competent jurisdiction to prevent or stop misuse of the Website, misuse of products, infringement or misappropriation of intellectual property, unauthorized access, fraud, unlawful activity, or conduct that may create regulatory, safety, or compliance risk.

FirstForm Peptides reserves the right to modify or terminate its affiliate program or terms at any time in its sole discretion, with or without notice. Terminated affiliates are permanently barred from re-enrolling in the program. FirstForm Peptides’ determination of a violation shall be final and binding.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be reformed to the minimum extent necessary to make it valid and enforceable while preserving its intent, or if such reformation is not possible, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
